Agreement to terms

By accessing or using Motarva ("the Platform") at https://motarva.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

These terms constitute a legally binding agreement between you and Motarva ("we", "us", "our"), operated by Beuzze, VAT BE 0754.641.390, Belgium.

Eligibility

You must be at least 16 years old to create an account
You must provide accurate and complete registration information
You are responsible for maintaining the security of your account credentials
One person may only maintain one account

Your account

You are responsible for all activity under your account
You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these terms
You may delete your account at any time from your account settings

User content

Routes

By uploading or creating a route on Motarva, you:

Retain ownership of your route data
Grant Motarva a non-exclusive, worldwide, royalty-free license to display, distribute, and make your public routes available to other users
Confirm you have the right to share the route data and it does not infringe on any third party's rights
Accept that public routes may be downloaded by other users in GPX, TCX, FIT, and ITN formats

Reviews

When submitting reviews, you agree to:

Provide honest and fair assessments based on your experience
Not post defamatory, offensive, or misleading content
Not use reviews for spam, advertising, or self-promotion

We reserve the right to remove reviews that violate these guidelines.

General content rules

You agree not to upload or submit content that:

Is illegal, harmful, threatening, abusive, or harassing
Contains malware, viruses, or malicious code
Infringes on intellectual property rights of others
Contains personally identifiable information of third parties without consent
Is spam or unsolicited promotional material
Intentionally provides dangerous or misleading route information

Zero tolerance and enforcement

We have zero tolerance for objectionable content and for abusive behaviour towards other riders. Content that breaks the rules above, and riders who harass or abuse others, are not welcome on Motarva.

Every route, review and photo can be reported, and you can block any rider so their content no longer reaches you. We review reports and act on them promptly: we remove content that breaks these rules and, where needed, suspend or remove the accounts behind it. We may take these steps with or without a report, and these decisions are ours to make.

Posting objectionable content or abusing other riders can lead to your content being removed and your account suspended or deleted, without notice.

Route safety disclaimer

Routes shared on Motarva are user-generated content. We do not verify, endorse, or guarantee the safety, accuracy, or legality of any route. By using route data from this platform, you acknowledge that:

You ride at your own risk and are solely responsible for your safety
Road conditions, regulations, and accessibility can change without notice
Routes may contain errors, be outdated, or pass through restricted areas
You must obey all local traffic laws and regulations
You should always verify route conditions before riding, especially in unfamiliar areas
Motarva is not liable for any accidents, injuries, or damages arising from following routes on the platform

XP, badges, and rewards

XP (experience points) and badges are earned through legitimate platform activity
We reserve the right to adjust XP values, level thresholds, and badge criteria at any time
Attempting to manipulate XP through fake accounts, automated actions, or abuse of features may result in XP removal and account suspension
Referral rewards are only granted for genuine new users who register and engage with the platform
Self-referrals or fraudulent referral activity will result in removal of referral rewards
XP and rewards have no monetary value and cannot be exchanged for cash

Motarva Pro subscriptions

Motarva Pro is an optional paid subscription, sold only inside the Motarva app for iPhone. Everything else stays free: motarva.com, browsing and downloading community routes, uploading your own, navigating a route from its route page, XP, badges and the leaderboard.

Motarva Pro Yearly costs 19.99 EUR per year and includes a free first week for riders who have not subscribed before.
Motarva Pro Week Pass costs 2.99 EUR per week and has no free week.
Prices are shown in the app before you confirm and can differ per country. The price you see in the app is the price that applies.
Payment is charged to your Apple ID account when you confirm the purchase.
Both plans renew automatically at the same price unless you cancel at least 24 hours before the current period ends. Apple charges the renewal within the 24 hours before that period ends.
You can manage or cancel a subscription at any time in your Apple ID settings. Deleting the app does not cancel a subscription.
If you buy a subscription while a free trial is running, the unused part of that trial is forfeited.
All payments, renewals and refunds are handled by Apple under the App Store terms. Refund requests go to Apple at reportaproblem.apple.com, not to Motarva.
When a subscription ends, Pro features stop at the end of the period you paid for. Your account, your routes, your XP and your badges are not affected.
We may change what Motarva Pro includes or what it costs. A price change on a running subscription only takes effect at the next renewal, and Apple asks you to confirm it first.

Your use of the Motarva app is also covered by Apple's standard licensed application end user licence agreement. Read Apple's standard terms

Intellectual property

The Motarva name, logo, and branding are our intellectual property
The platform's design, code, and original content are protected by copyright
Map data is provided by OpenStreetMap contributors under the ODbL license
You may not copy, modify, or redistribute the platform's code or design without permission

Limitation of liability

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law:

We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform
We do not guarantee uninterrupted or error-free operation of the Platform
We are not responsible for the accuracy or completeness of user-generated content
Our total liability is limited to the amount you paid us (if any) in the 12 months preceding the claim

Termination

We may suspend or terminate your account at any time for violation of these terms
You may delete your account at any time from your account settings. Account deletion is permanent and cannot be undone
Upon account deletion, all personal data (profile, XP, badges, reviews, favorites, and vehicles) will be permanently removed
All routes (published, draft, and private) and their associated images are retained as community content and attributed to "Deleted User". By uploading a route, you grant Motarva a perpetual license to display it even after account deletion
Upon termination, your license to use the Platform ends immediately
Provisions regarding intellectual property, liability, and indemnification survive termination

Changes to these terms

These terms are dynamically generated based on the features currently active on the platform. When features are added or removed, these terms automatically reflect those changes. Continued use of the Platform after changes constitutes acceptance of the updated terms.

Governing law

These terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these terms or your use of the Platform shall be resolved in the competent courts of Belgium.
